1. Not medical advice

Nitya Health is a wellness and self-tracking tool. Content in the Services, including cycle predictions, habit suggestions, workout plans and AI coach responses, is for general information only. It is not medical advice and does not diagnose, treat, cure or prevent any disease or condition.

Always consult a qualified doctor or healthcare professional about medical concerns, before starting supplements, or before changing your diet, exercise or treatment. Never ignore professional medical advice or delay seeking it because of something you read in the Services. In a medical emergency, contact your local emergency services immediately.

2. Cycle predictions are not contraception

Period, ovulation and fertile-window predictions are estimates based on the information you log. They can be wrong and must not be used as a method of contraception or to plan or avoid pregnancy.

3. Eligibility

You must be at least 18 years old, or the age of majority where you live, to use the Services, and able to form a binding contract. By using the Services you confirm that you meet these requirements.

4. Your account

You are responsible for the accuracy of the information you provide, for keeping your sign-in details secure, and for all activity under your account. Tell us promptly at founder@nityahealth.in if you suspect unauthorised use.

5. Acceptable use

You agree not to:

• Use the Services for any unlawful, harmful or fraudulent purpose.
• Attempt to access other users’ data, or probe, disrupt or overload our systems.
• Copy, reverse engineer, decompile or create derivative works of the app, except where the law expressly allows.
• Use bots, scrapers or automated means to access the Services, or use them to build a competing product.
• Try to make the AI coach produce harmful, abusive or illegal content.

6. AI-generated content

The AI health coach generates responses automatically. Responses may be inaccurate, incomplete or not suitable for your situation, and you should use your own judgement and professional advice before acting on them. We are not responsible for decisions you make based on AI-generated content.

7. Your data and content

You own the data and content you add to the Services. You give us a limited licence to store, process and display it only to provide, secure and improve the Services for you, as described in our Privacy Policy. You can delete your data at any time by deleting your account or emailing founder@nityahealth.in.

8. Our intellectual property

The Services, including the app, website, design, text, graphics, logos and software, are owned by Nitya Health or its licensors and are protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial purposes in line with these Terms.

If you send us feedback or ideas, we may use them freely without any obligation to you.

9. Pricing and changes to the Services

Nitya Health is currently free to download. If we introduce paid features in the future, we will show the price and terms clearly before you are charged, and any purchases will be processed through Google Play under its terms.

We are continually improving the Services and may add, change or remove features, or suspend or discontinue the Services, at any time. We will try to give reasonable notice of significant changes.

10. Third-party services

The Services may rely on or link to third-party services such as Google Play. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

11. Termination

You can stop using the Services and delete your account at any time. We may suspend or end your access if you breach these Terms or if we need to for legal or security reasons. Sections that by their nature should survive termination, including disclaimers, limitations of liability and governing law, will survive.

12. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free or secure, or that predictions or suggestions will be accurate.

13. Limitation of liability

To the fullest extent permitted by law, Nitya Health will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, health outcomes, profits or goodwill, arising from your use of or inability to use the Services. Our total liability for any claim relating to the Services is limited to the amount you paid us, if any, in the twelve months before the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law, or your statutory rights as a consumer.

14. Indemnity

You agree to indemnify and hold Nitya Health harmless from claims, losses and expenses (including reasonable legal fees) arising from your misuse of the Services or your breach of these Terms.

15. Governing law and disputes

These Terms are governed by the laws of India. Subject to any mandatory consumer protection rules in your country of residence, the courts of India have exclusive jurisdiction over any dispute arising from these Terms or the Services. Before starting formal proceedings, please contact us so we can try to resolve the issue informally.

16. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page with a new “last updated” date and, for significant changes, notify you in the app or by email. By continuing to use the Services after changes take effect, you accept the updated Terms.
